Acceptable Use Policy

This Acceptable Use Policy ("AUP") is incorporated into and forms part of the Terms of Service at https://respawn.sh/trust/tos. Capitalized terms not defined here have the meanings in the Terms of Service. Violation of this AUP is a material breach of the Terms of Service. The limitations of liability in Terms of Service Section 17 apply in full to all enforcement actions and non-enforcement decisions under this AUP.

1. Purpose and Scope

1.1 Purpose

This AUP establishes the standards of conduct and content restrictions applicable to all use of the Service. It exists to protect the integrity, security, and availability of the Service; to protect users, third parties, and the Company from harm; and to ensure the Company's continued ability to operate the Service in compliance with applicable law.

1.2 Scope

This AUP governs all content uploaded, stored, transmitted, or made accessible through the Service by any User, and all conduct in connection with the use of the Service. It applies to all users regardless of Subscription Plan, account type, jurisdiction, or the nature of the Minecraft server being backed up.

1.3 Relationship to Terms of Service

This AUP supplements and does not replace the Terms of Service. In the event of any conflict, the Terms of Service govern. All protections, disclaimers, and liability limitations in the Terms of Service apply to all actions taken or not taken under this AUP.

2. Permitted Use

The Service is licensed exclusively for creating, storing, managing, and restoring automated backups of Minecraft server data (world files, plugin data, server configurations, and related files), and accessing the Service through the Plugin, dashboard, and API in accordance with the Terms of Service. Any use outside this scope requires our prior written consent.

3. Prohibited Content

You must not use the Service to store, upload, transmit, or distribute any of the following:

3.1 Child Sexual Abuse Material

Any child sexual abuse material (CSAM) or sexualized depiction of minors in any form whatsoever. This is an absolute prohibition. Detection results in immediate account termination, permanent ban, mandatory referral to NCMEC's CyberTipline (18 U.S.C. § 2258A), and cooperation with law enforcement. No exceptions exist under any circumstances.

3.2 Illegal Content

Content that constitutes, facilitates, promotes, glorifies, or enables any criminal offense under applicable local, state, federal, or international law, including but not limited to: human trafficking, exploitation, or modern slavery; terrorism, violent extremism, or mass violence; drug manufacturing, distribution, or trafficking; weapons trafficking or manufacturing; money laundering or financial fraud; violation of export control, sanctions, or trade embargo laws; or any other content whose creation, possession, or distribution is criminally prohibited in the applicable jurisdiction.

3.3 Intellectual Property Violations

Content that infringes, misappropriates, or violates the copyright, trademark, patent, trade secret, or other intellectual property rights of any third party; software, media, or data that the user does not have the legal right to store, reproduce, or distribute; or content that circumvents, defeats, or assists in circumventing digital rights management (DRM) or copy-protection mechanisms.

3.4 Privacy Violations

Content that contains personal data of third parties collected or stored in violation of applicable privacy law, including GDPR, UK GDPR, VCDPA, CCPA/CPRA, PIPEDA, or any other applicable data protection regime; content that constitutes unauthorized surveillance, monitoring, tracking, stalking, or doxxing of any individual; content that involves non-consensual sharing, distribution, or publication of private or intimate images or information; or content that facilitates identity theft or fraud.

3.5 Malicious Software and Code

Content that constitutes malware, ransomware, spyware, adware, trojans, viruses, worms, keyloggers, rootkits, backdoors, or any other malicious code or software designed to: damage, disrupt, destroy, or gain unauthorized access to systems, devices, networks, or data; surveil, monitor, or extract information from systems without authorization; encrypt, corrupt, or hold hostage data for extortion; or facilitate any other unauthorized or harmful activity.

3.6 Hate Speech and Discriminatory Content

Content that promotes hatred, discrimination, dehumanization, or violence against any person or group on the basis of race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, age, or any other protected characteristic; content that constitutes incitement to violence or harassment; or content that promotes or glorifies ideologies or organizations designated as extremist, terrorist, or hate groups by applicable governmental authorities.

3.7 Harassment and Abuse

Content that constitutes targeted harassment, coordinated abuse, intimidation, or threats against any individual or group; content designed to dox, expose, or harm specific individuals; content that facilitates cyberbullying or systematic abuse campaigns; or content that facilitates swatting or similar dangerous activities.

3.8 Deceptive and Fraudulent Content

Content that constitutes fraud, phishing, social engineering, or impersonation of any person, company, or service; content that contains deliberately false or misleading information designed to deceive or cause harm; fake reviews, testimonials, or endorsements; or content designed to facilitate scams, pyramid schemes, or fraudulent financial schemes.

3.9 Dangerous and Harmful Content

Content that provides instructions for manufacturing weapons, explosives, biological agents, chemical agents, or other materials capable of causing serious physical harm; content that facilitates self-harm, suicide, or harm to others; or content that targets minors for exploitation, grooming, or harm of any kind.

3.10 Sanctioned and Embargoed Content

Content belonging to, originating from, or intended for the benefit of any person, entity, or territory subject to applicable U.S. or international economic sanctions, trade embargoes, or export control restrictions, including but not limited to persons designated on the OFAC SDN list or any other applicable denied parties list.

4. Prohibited Conduct

You must not engage in any of the following conduct in connection with the Service:

4.1 Unauthorized Access and Security Violations

Attempting to gain unauthorized access to any part of the Service, any other user's account, or any third-party system; circumventing, disabling, or tampering with any security measure, access control, rate limit, or authentication system; conducting penetration testing, vulnerability scanning, or security research on the Service without our prior written consent; or using or attempting to use another user's account, credentials, API keys, or access tokens.

4.2 System Abuse and Resource Exploitation

Using the Service for any purpose other than Minecraft server backup and recovery; using backup storage as general-purpose object storage, file hosting, or content delivery; using the Service API as a general compute or data processing backend; running cryptocurrency mining, automated trading, benchmark loads, network scanning, port scanning, or any resource-intensive computation through or against Service infrastructure; generating artificial traffic, bot-driven requests, or load patterns designed to consume Service resources disproportionately; or using the Service in any manner that degrades performance, availability, or experience for other users.

4.3 Reverse Engineering and Tampering

Reverse-engineering, decompiling, disassembling, or attempting to derive the source code, algorithms, structure, or design of the Plugin or any part of the Service; modifying, creating derivative works of, or patching the Plugin without authorization; or removing, altering, or obscuring any proprietary notices, copyright notices, or license terms associated with the Service or Plugin.

4.4 Commercial Exploitation Without Authorization

Reselling, sublicensing, white-labeling, rebranding, or otherwise commercially exploiting the Service, the Plugin, or any component thereof, without our prior written consent; framing, scraping, or embedding any part of the Service in another product or website without authorization; or using the Service to provide a backup service to third-party customers without our prior written consent.

4.5 Account and Identity Violations

Creating or operating more than one respawn.sh account per individual; creating accounts using false, fictitious, or fraudulent registration information; creating accounts on behalf of another person without their explicit authorization; using automated scripts, bots, or other automated means to create accounts; or impersonating the Company, any employee, any other user, or any third party in any communication or within the Service.

4.6 Legal and Regulatory Violations

Using the Service in violation of any applicable law, regulation, court order, or governmental directive; using the Service to facilitate or assist in any activity that violates applicable law; using the Service in any manner that subjects the Company to legal liability; or using the Service from any jurisdiction where doing so would violate applicable law.

4.7 Interference and Disruption

Interfering with, disrupting, or attempting to disrupt the integrity, security, performance, or availability of the Service, its infrastructure, or any related services; transmitting any material that contains software viruses or any other malicious code designed to damage, destroy, or interfere with the Service; attempting to overload, flood, spam, or crash any part of the Service; or coordinating with third parties to conduct any of the above.

4.8 Backing Up Prohibited Servers

Backing up a Minecraft server that is itself used to host, facilitate, distribute, or operate prohibited content as described in Section 3, regardless of whether the prohibited content is directly identifiable in the resulting backup archive.

4.9 Misrepresentation and Deception

Misrepresenting your identity, affiliation, the nature of your server, or your intended use of the Service; providing false or misleading information to us, to other users, or in connection with any support, abuse, or legal request; or obstructing any investigation conducted by us in accordance with the Terms of Service.

5. Content and Server Responsibility

5.1 Sole Responsibility

You are solely and entirely responsible for all content stored, uploaded, transmitted, or made accessible through your use of the Service, including all plugins, world data, player data, configurations, and any other data contained in the Minecraft server(s) you back up.

5.2 No Pre-Screening

We do not pre-screen Backup Content before it is stored. We make reasonable technical efforts to detect prohibited content through available signals including file type, metadata, MIME type detection, and hash-based matching, but we cannot fully inspect the contents of all backup archives and are under no obligation to do so.

5.3 Non-Detection Does Not Excuse

Our inability to detect a violation of this AUP does not excuse the violation, does not constitute authorization of the prohibited content or conduct, and does not create any liability for us. The limitations of liability in Terms of Service Section 17 apply fully to all failures to detect, prevent, or remove prohibited content.

5.4 Third-Party Player Data

To the extent your Backup Content contains personal data of your Minecraft server players or other third parties, you are the Data Controller for that personal data. You are solely responsible for obtaining all required consents, providing all required privacy notices, and complying with all applicable data protection laws in respect of that personal data. We process such data only as your Data Processor, in accordance with our Privacy Policy.

6. Reporting Violations

6.1 How to Report

If you become aware of content stored through the Service that you believe violates this AUP or applicable law, report it using the contact information on the Main Website.

6.2 CSAM Reporting

For any report involving child sexual abuse material, we will also report to the National Center for Missing and Exploited Children (NCMEC) CyberTipline as required by 18 U.S.C. § 2258A and will cooperate fully with law enforcement.

6.3 No Liability for Reports

We are not liable for any action taken or not taken in response to any report, including any removal or non-removal of content. The limitations of liability in Terms of Service Section 17 apply to all reporting-related actions and omissions.

7. Enforcement

7.1 Right to Enforce

We reserve the right, in our sole and absolute discretion, to take any of the following actions in response to an actual or suspected violation of this AUP: investigate any suspected violation; access and review Backup Content where we have reasonable grounds to suspect a violation, consistent with the Terms of Service and Privacy Policy; remove or disable access to content that we determine violates this AUP; suspend access to some or all features of the Service; permanently terminate your account without notice or refund; report illegal content or activity to law enforcement, regulatory agencies, or other appropriate bodies; cooperate with legal process, subpoenas, and governmental investigations; and pursue all available civil and criminal remedies.

7.2 No Monitoring Obligation

We have no obligation to proactively monitor all Backup Content for violations of this AUP. Our right to enforce this AUP does not create an obligation to do so in any particular instance or with respect to any particular content or user.

7.3 No Liability for Enforcement or Non-Enforcement

We are not liable for any failure to detect, remove, or act on prohibited content. We are not liable for the consequences of any enforcement action taken in good faith. The full limitation of liability provisions in Terms of Service Section 17 apply to all enforcement and non-enforcement decisions under this AUP.

7.4 Cooperation with Law Enforcement

We will cooperate with law enforcement agencies and governmental authorities in connection with investigations of illegal activity involving the Service, including by providing information, access, or evidence as required by applicable law or valid legal process.

8. Consequences of Violation

8.1 General Consequences

A material violation of this AUP may result in any or all of the following, without prior notice, without refund, and without opportunity to cure: immediate suspension of your account; permanent termination of your account; deletion of all User Data; referral to law enforcement or regulatory authorities; civil or criminal liability under applicable law; permanent ban from creating new accounts; and pursuit of all available damages and remedies.

8.2 Absolute Consequences for CSAM

Any violation involving CSAM or the sexualization or exploitation of minors will result in: immediate permanent account termination; immediate deletion of all associated User Data; mandatory referral to NCMEC and law enforcement; and cooperation with all law enforcement investigations. No exceptions, no warnings, no second chances.

8.3 Proportionality

For violations that do not fall under Section 8.2, we may, but are not required to, issue a warning or notice before taking enforcement action. The severity of any enforcement response will be proportionate to the nature, gravity, and frequency of the violation, in our reasonable discretion.

9. Updates

We may update this AUP at any time by posting a revised version on the Main Website. We will use reasonable efforts to notify you of material changes at least 14 days before they take effect. Your continued use of the Service after the 14-day notice period constitutes acceptance of the updated AUP. If you do not agree to a modification, you must stop using the Service before the changes take effect.
